ПРАВА ЧЕЛОВЕКА И "СЕПАРАТИСТСКИЕ" ТРЕБОВАНИЯ МУЛЬТИКУЛЬТУРАЛИЗМА

Аннотация

Статья содержит положение о правах человека как фундаментальном принципе западной правовой мысли, который подвергается эрозии под влиянием концепции мультикультурализма. Авторы статьи считают, что толерантность как формула терпимости к культурным различиям в трактовке мультикультурализма утверждает обоснованность и правового неравенства социальных индивидов, и создает ситуацию конструирования особых коллективных прав, распространение их на этнос и преимущество титульной нации. Поэтому, заключают авторы статьи, культурные притязания, права этносов могут трактоваться только как право на культурные различия в сфере соблюдения гражданских прав личности.

Abstract

This article contains a human rights clause as a fundamental principle of Western legal thought, which eroded under the influence of the concept multikuluralizma. The authors believe that the formula tolerance tolerance for cultural differences in the interpretation of multiculturalism affirms the validity and legal inequities of social individuals, and special design creates a situation of collective rights, spread them on ethnicity and the advantage of the titular nation. Therefore, conclude the authors, cultural claims, rights of ethnic groups can be interpreted only as the right to cultural differences in the civil rights of the individual.
