ИНСТИТУЦИОНАЛЬНАЯ МОДЕРНИЗАЦИЯ СИСТЕМЫ ГОСЗАКУПОК: ЗОНЫ РИСКА

Аннотация

В статье на основе анализа мирового опыта проведен аудит институциональных оснований минимально рискованной системы госзакупок. Дефинирована предметно-содержательная характеристика институциональной модернизации системы госзакупок и выделены этапы ее эволюции в РФ. В качестве зон рисков системы госзакупок идентифицированы: персонификация государства как потребителя конкретным чиновником с рентоориентированным поведением, что обусловливает риск неудовлетворения потребностей общественного сектора; оппортунистическое поведение участников торгов по госзакупкам, тестируемое на всех этапах контрактной системы; неопределенность политики государства в законодательной области, качество планирования потребностей, обоснованность закупок и их финансовое обеспечение, нерациональность действий заказчиков, качество исполнения государственного контракта и его условий. Предложены меры по локализации зон рисков системы госзакупок.

Abstract

The article based on the analysis of international experience have audited the institutional bases minimally
risky procurement system. Typeable detail-substantial characteristics of the institutional modernization of
the public procurement system and marked the stages of its evolution in the Russian Federation. As the
areas of public procurement system risks are identified: the personification of the state as a consumer with
specific official rent-seeking behavior that leads to the risk of unmet needs of the public sector; opportunistic behavior of bidders for public procurement, the test at all stages of the contract system; the uncertainty of the state policy in the field of legislation, quality requirements planning, procurement, and the validity
of their financial support, the irrationality of actions of customers, the quality of the public execution of the
contract and its terms and conditions. The analysis of signs of corruption in the actions of state and local
government clients in the formation and deployment in a single information system procurement for state
and municipal needs of notices and documentation on ongoing procurement. The measures to localize
areas of risk procurement system.
